SCCC Library Confidentiality Policy

New York State Law (NY CPLR - 4509) prohibits the disclosing of patron library records to anyone but the patron or by court order. Accordingly, the SCCC libraries will only disclose user records upon the request of the user, or pursuant to a court order. When served with a warrant or a court order, the following procedures will take place.

  1. The library staff will ask the person serving the court order* to identify themselves and see credentials.
  2. Library staff will contact the campus Head Librarian/Associate Dean of Libraries or their designee.
  3. The campus Head Librarian/Associate Dean of Libraries or his designee will contact the Vice President Legal, Planning and Information Services.
  4. Library staff will request that the court order* will not be executed until the college's legal counsel had a chance to review the document.
  5. If the officer insists on executing the court order*, library staff should allow the officer access to all information that is listed on the court order. They should also request to keep a copy of the court order.
  6. If the officer takes any equipment from the library, the staff should ask the officer for a receipt for the equipment.
  7. Library staff should not discuss the incident with anyone outside the library until the matter is addressed by the Vice-President of Legal, Planning and Information Services.
    *The only court order that can be complied with upon the insistence of the officer (and at the time of service) is a warrant, not a subpoena. The subpoena can be handled after the officer serves it and leaves.

Record Retention Policy

SCCC libraries retain the following user records:

  • Electronic Circulation records-One day or until the materials are returned
  • Paralegal sign in sheets-One month
  • Interlibrary loan requests, media & periodical circulation records-One month or until the materials are returned
  • Internet history on workstations-Cleared after one day
